3. No Guarantees of Results.

While our Services aim to assist with anti-aging, cognitive function, and weight management, individual results may vary. We do not guarantee specific outcomes or results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OPTIMAL LIFE OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY.

2. Maximum Liability.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Optimal Life and its affiliates from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to your use or misuse of the Services, your breach of these Terms, or your violation of any third-party rights.

12. Dispute Resolution and Governing Law

1. Governing Law.

These Terms shall be governed by and construed in accordance with the laws of TN, without regard to conflict-of-law principles.

2. Arbitration.

Any dispute arising from these Terms or the Services will be resolved through binding arbitration in Cheatham County, TN, unless otherwise required by applicable law. You and Optimal Life agree to waive any right to a jury trial.

3. Class Action Waiver.

You agree that any dispute resolution shall be conducted on an individual basis and not as a class action, private attorney general action, or other representative action.


13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will post the revised Terms on our website and update the “Effective Date” at the top. Your continued use of the Services following the posting of changes indicates your acceptance of the revised Terms.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
